Terms of Service applies automatically to all Hypernet Company Ltd.
[hereafter referred to as "Hypernet"] clients upon subscription to the
Services including subscription through a third party or any commercial
partner. BY SUBSCRIBING TO OUR SERVICES, YOU ACCEPT THE POLICIES LISTED
IN THIS DOCUMENT AND ACCEPT TO RESPECT THEM. The service order is
described as the package description as presented on the web site or the
" service order " document in case of dedicated server services.

1. General

Hypernet,
agrees to provide services described in the Service Order(s) signed by
the parties (Â“ServicesÂ”) to the customer subject to the following
Terms of Service. Use of our services constitutes acceptance and
agreement to these Terms of Service and all attachments. We will make
all reasonable efforts to provide a quality service to our Customer.

We agrees to provide the client VPN service for a
monthly/quarterly/semi-annual/annual fee. We will never require clients
to advertise for Hypernet on their website in any way shape or form
unless agreed upon such as a non-profit organization receiving
complimentary hosting.

Hypernet reserves the right to change this agreement at any time without notice.

2. ACCOUNTS CAN BE REFUSED AND/OR DISCONTINUED AT HYPERNET DISCRETION.

This
is a very careful and secure company and WE WILL check your customer
input to confirm your information. Any irregularities will be cause for
refusal. We do not have instant activation for this reason. but we do
have HIGHLY satisfied customers on a clean service as a result.

Violation of any of Hypernet's Rules and Regulations could result in a
warning, suspension, or possible account termination. Accounts
terminated due to policy violations will not be refunded. Free domains
which have been granted for customers paying annually are released to
the customer at the end of there hosting period. Domains terminated due
to policy violations will not be released to the customer.

3. Account Setup

We
will setup your account after we have received payment and we and/or
our payment partner(s) have screened the order(s) in case of fraud. It
is your responsibility to provide us with an email address which is not @
the domain(s) you are signing up under. If there is ever an abuse issue
or we need to contact you, the primary email address on file will be
used for this purpose. It is your responsibility to ensure the email
address on file is current or up to date at all times.

Hypernet is not responsible for a lapsed registration due to outdated
contact information being associated with the service. If you need to
verify or change this information, you should contact our sales team via
email. Providing false contact information of any kind may result in
the termination of your account. In dedicated server purchases or high
risk transactions, it will be necessary to provide government issued
identification and possibly a scan of the credit card used for the
purchase. If you fail to meet these requirements, the order may be
considered fraudulent in nature and be denied.

4. Contents

All services provided by Hypernet may be used for lawful purposes only.

Transmission, storage, or presentation of any information, data or
material in violation of any Philippines (or any other country) law is
prohibited. This includes, but is not limited to: copyrighted material,
material that is threatening or obscene, or material protected by trade
secrets and other statue.

The customer agrees to indemnify and
hold harmless Hypernet from any claims resulting from the use of the
service which damages the subscriber or any other party.

Account will be automatically terminated with or without any notice if found out any of unacceptable contents listed above.

We reserve the right to refuse service to anyone. Any material that, in
our judgment, is obscene, threatening, illegal, or violates our terms
of service in any manner may be removed from our servers (or otherwise
disabled), with or without notice.

Failure to respond to email
from our abuse department within 48 hours may result in the suspension
or termination of your services. All abuse issues must be dealt with via
troubleticket/email and will have a response within 48 hours.

Resellers: we will suspend the account in question and will notify you
so you may terminate the account. We will further monitor your activity;
more than one infraction of this type may result in the immediate
termination of your account.

Direct customers: Your services will be terminated with or without notice.

5. Intellectual Property Rights

Material
accessible to you through Hypernet's Services may be subject to
protection under the Republic of the Philippines (or any other country)
copyright laws, or laws protecting trademarks, trade secrets or
proprietary information. Except when expressly permitted by the owner of
such rights, you must not use the Hypernet Service in a manner that
would infringe, violate, dilute or misappropriate any such rights, with
respect to any material, which you access or receive through the
Hypernet Network. If you use a domain name in connection with the
Hypernet Service or similar service, you must not use that domain name
in violation of any trademark, service mark, or similar rights of any
third party.

6. Spam or Unsolicited E-Mail

You
must not use the Hypernet Network, Hypernet equipment or any Hypernet
email address in connection with the transmission of spam, flames, mail
bombs, or substantially similar, unsolicited email messages. Your domain
may not be referenced as originator, intermediary, or reply-to address
in any of the above. This prohibition extends to the sending of
unsolicited mass mailings from another service that in any way
implicates the use of the Hypernet Network, Hypernet Company Ltd.
equipment or any Hypernet email address. A message is considered
unsolicited if it is posted in violation of a newsgroup charter or if it
is sent to a recipient who has not requested or invited the message.
For purposes of this provision, merely making one's email address
accessible to the public will not constitute a request or invitation to
receive messages.

If you are found to have spammed, Hypernet
reserves the right to disable your account with or without warning.
Hypernet solely reserves the right to refuse or cancel service to known
spammers. Lastly, Hypernet reserves the right to determine what violates
this policy. As such, any violation may result in cancellation of
services without refund.

7. Abuse

Any
attempts to undermine, slander, libel, threaten, or cause harm to a
Hypernet server, customer, employee, or the company directly is strictly
prohibited and is grounds for immediate termination without any refund.

Backup and Account Restoration

Client are solely and entirely responsible, and Hypernet is in NO way
responsible, for the management and backup of all client's data, and all
updates, upgrades, and patches to any software that customers use in
connection with Hypernet services.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Hypernet
(or it's employee's/owners) harmless from any and all demands,
liabilities, losses, costs and claims, including reasonable legal fees
asserted against Hypernet, its agents, its customers, officers and
employees, that may arise or result from any service provided or
performed or agreed to be performed or any product sold by customer,
it's agents, employees or assigns. Customer agrees to defend, indemnify
and hold harmless Hypernet against liabilities arising out of; (1) any
injury to person or property caused by any products sold or otherwise
distributed in connection with Hypernet server; (2) any material
supplied by customer infringing or allegedly infringing on the
proprietary rights of a third party and (3) copyright infringement.
Customer agrees to limit the liability of Hypernet to the amount paid
for service.

Unlimited Bandwidth Terms

The use of the any unlimited disk space or bandwdith package is subject to the following terms:

All accounts must have valid, working account, and not violate any previously subscribed terms
Any
accounts found to violate these terms may be suspended without
notice until the account holder agrees to resolve the issue..

News and Updates

News and any updates for in any of Hypernet services will be posted in our website http://www.MASTER.CHIEFS.TV

Third-Party Application Support

Hypernet will not guarantee or provide any technical support for any free third-party application available

Refund and Cancellation Policy

For payment, Hypernet accepts Gcash, Smart Money or Western Union.

You may cancel your account at any time and receive a full refund if
cancelled within our 24 hour (from the account subscription date)
money-back guarantee period. To receive this refund, you may not be on a
custom package of any sort. You must be on one of the pre-created
packages/plans by Hypernet that is listed on our site. You may cancel
for any reason. Refunds are not available for account renewal or if the
account has violated any terms on this page.

If after 24 hours
from the start of your account subscription you wish to cancel your
account, you will receive no refund of any monies already paid to
Hypernet Company Ltd.

Late Payment

All payments are due in full on the monthly anniversary date. Failure
to remit payment for services within two (2) consecutive days including
the monthly anniversary date shall result in automatic temporary
suspension of the account without any notice.

You will receive a
payment reminder everyday from the start of your payment due date. If
after 3 days payment has not been received or we have not been contacted
regarding payment, your account will be terminated without any further
notice.

Cancellation

You must use only one of following methods to deliver a official
written notice of cancellation: Please send an official cancellation
request through email or personally to our office. On receipt your
account will be pending cancellation within 24 hours. Please include
your Name, domain name, username, password and your reason for
canceling.

Disclaimer

Hypernet will not be responsible for any damages your business may
suffer. Hypernet makes no warranties of any kind, expressed or implied
for services we provide. Hypernet disclaims any warranty or
merchantability or fitness for a particular purpose. This includes loss
of data resulting from delays, non-deliveries, wrong delivery, and any
and all service interruptions caused by Hypernet and its employees.
Hypernet makes a 99.9% Uptime guarantee.

Hypernet keeps daily
backups of their servers. Hypernet can accept no responsibility for any
loss of data or consequences arising from this. Hypernet always advises
clients to back up their site data regularly for its own protection.

Hypernet furthermore expects that its customers who provide hosting
services (resellers) to others will ensure its customers fully comply
with all applicable laws concerning the privacy of online communications
and any other policy of Hypernet. A customer's failure to comply with
those laws will violate this policy.

If a customer provides
hosting services (resellers) to others and decides to cancel their
reseller hosting account with Hypernet then Hypernet will not be
responsible for maintaining hosting for the resellers customers.

Finally, Hypernet wishes to emphasize that in accepting services,
customers indemnify Hypernet for the violation of any law or Hypernet
policy, that results in loss to Hypernet or the bringing of any claim
against Hypernet. This means that if Hypernet is sued because of
activities of the customer that violate any law, or this policy, the
customer will pay any damages awarded against Hypernet, plus costs and
reasonable legal fees.

Failure to comply with any of our terms
& conditions will result in grounds for immediate account
termination without any notice.

Rights reserve

Hypernet reserves the right to change, edit, or update the policies
contained in this document, along with the content on our website at any
time for any reason without notice.

Because Hypernet takes privacy issues seriously and wants to protect your rights we have established this Privacy Policy. Please make sure you understand our policy on this matter and feel free to contact us if you have any questions or issues regarding this document.

Personal Information Usage
Hypernet will not search to sell, rent, lend, exchange or give your mail address, your zip code or your phone number at a third party without your explicit permission. The information provided by you are protected and can't be found by a outside person. We will use the customer's personal information only as reasonably necessary to provide contracted services and to collect fees owed.

Disclosure of Personal Information
The Customer authorizes Hypernet to use it's name, business name, city or country informations and comments in marketing documents or as testimonials on Hypernet's web site. At any time, the Customer can send a written notice to withdraw this authorization. Hypernet will only disclose personal information to a third party if required by law as evidenced by a valid Court Order of competent jurisdiction or to a collection agency if needed.

Disclosure of Non-Personal Aggregates
Hypernet could share with its partners or third parties a non-personal anonymous aggregate of informations about its users or web site visitors. For example, we could provide statistics data about the number of users of a particular area. The transmitted information is for statistic and will not reveal in any way your identity.
